Vendors Terms and Conditions of Sale.
All charges are subject to VAT at the current rate with specific exceptions.
- Commission is charged at the rate of 20% on the hammer price of each Lot with a minimum charge of £3.50 plus VAT per Lot whether sold or not. Lots selling for £17.50 or less, or unsold will attract a charge of £3.50 plus VAT
- Items presented or collected for sale will be entered in the first available sale, but may be held over, at the Auctioneers discretion, until space or a suitable sale is available.
- All descriptions are at the Auctioneers discretion.
- All items held for sale or storage are insured and a charge of 1% plus VAT will be levied on each lot.
- Payments are available for collection 13 days after a sale. Postal payments will be sent out , 2nd class, 19 days after a sale.
- We will not produce a cheque if the amount owed to a vendor is less than £30.00. The vendor is expected to collect the amount in cash from the office.
- Payment to Vendors is not made until the Auctioneers receive payment in full, in the event of a default the goods will be reoffered for sale.
- Lots failing to attract a bid will be deemed unsaleable and will be disposed of at the Auctioneers discretion and charged accordingly.
- Items not in compliance with current legislation or deemed unsaleable will be disposed of and the costs incurred will be payable by the Vendor.
- The Auctioneers act as agent for the vendor and reserve the right to bid on their behalf on Lots offered subject to a reserve.
- Each Vendor will supply their name, address, telephone number, emails address and VAT status and sign the Auctioneers entry form.
- Mains gas appliances are not sold by the Auctioneers.
- All electrical appliances will be tested by the Auctioneers electrician, in compliance with current regulations, and a charge of £2.00 plus VAT per item will be levied.
- The Auctioneers are registered with North Yorkshire County Council and all goods offered must be in compliance with current legislation as required by the Trading Standards Office.
- The auctioneers will not be responsible for any loss, damage or injury occasioned or sustained by persons on the premises.
- Where lots are offered without reserve the Auctioneers are legally obliged to sell these even if they only receive the minimum bid of £10.00 therefore the Auctioneer may bid on such lots on behalf of Thompson’s Auctioneers.
- If any lots are withdrawn, before the start of the sale at 10am on Friday, there will be a £5 plus VAT per lot charge.
- There is 10% auctioneers discretion on any reserve unless marked as fixed.

Buyers Terms and Conditions of Purchase

- The Purchaser to be the highest bidder who will pay the hammer price plus a premium of 20% plus VAT.
- We use www.easyliveauction.com bidding platform, you can bid “live” or leave “autobids” via their website. Please see their website for their terms. We do not have any control over their website. Should you have any difficulties then please contact them directly.
- In the case of a dispute the Lot may be re-offered at the discretion of the Auctioneer who shall be the sole arbitrator.
- Each purchaser shall register with the Auctioneers giving their Name, Address and Telephone Number and email address or create an account via www.easyliveauction.com
- All purchases must be paid for, in full, and no Lots may be removed until such payments have cleared.
- Payments are accepted in Cash, Credit Card, Direct Debit or BACS (online banking– details available from the office) We do not accept payments over the telephone.
- We no longer accept cheques as a form of payment.
- The Auctioneers act as agents for the Vendor and reserve the right to bid on their behalf on Lots offered subject to reserve.
- The Auctioneers will not be responsible for any loss, damage or injury occasioned to or sustained by persons on the premises.
- All descriptions and advice are given as opinions only and are at the Auctioneers discretion. Whilst the Auctioneers list any defects that they have found it is the Buyers responsibility to examine Lots and determine the condition at the time of sale as no refunds will be made after the fall of the hammer (Subject to current legislation)
- Commission bids/Autobids are accepted by the Auctioneers who undertake to purchase Lots on the bidders behalf at the best advantage. I authorise Thompsons’s Auctioneers to bid on my behalf up to and one bid over my amount.
- Lots marked in the catalogue with * are being sold for a VAT registered vendor and VAT at the appropriate rate will be added to the hammer price, as well as the buyers premium.
- Book purchases are not subject to VAT (where the Vendor is VAT registered)
- All electrical appliances are PAT tested by the Auctioneers electrician, in compliance with current safety regulations. This does not guarantee them to be in working order.
- Where mechanical and electrical goods are unmarked or marked as “W/O” (working order) the Auctioneers will refund the purchase price in full upon the return of the goods (in original condition) if found not to perform the task they were intended for, within seven days of purchase.
- The Auctioneers are registered with North Yorkshire County Council and all goods are offered in compliance with current legislation as required by the Trading Standards Office.
- We offer a full refund on any electrical items if they are faulty and returned within 7 days of purchase (unless described as A/F (as found) or S/R (spares and repairs).

Artist’s Resale Right
If you buy a work of art by a living artist or an artist who has died in the last 70 years, which costs more than the UK sterling equivalent of €1,000, you will have to pay a royalty relating to the Artists Resale Right Regulations 2006. The royalties are administered by the Design and Artists Copyright Society (DACS), or the Artist’s Collecting Society (ACS), and no handling costs are retained by Thompsons Auctioneers.
Items that may qualify for this royalty are marked in the catalogue with a tick next to the lot number.
The current royalty charge for qualifying items over €1,000 are:
Up to €50,000 – 4%
€50,000.01 to €200,000 – 3%
€200,000.01 to €350,000 – 1%
€350,000.01 to €500,000 – 0.5%
Exceeding €500,000 – 0.25%Royalty charges are calculated using the Euro to UK sterling exchange rate on the day of the sale.
